Life Insurance Claim FAQs

It’s common for insurance companies to deny claims and for claimants who have no legal background to not fully understand the reason for the denial. In addition, life insurance policies are contracts, and they contain insurance industry and legal terminology that’s not always clear.

A life insurance denial attorney can help increase your chance of a successful appeal. At Life Legal, we can evaluate your case to determine that you have a valid claim, then go to work on your behalf to help you get the benefits you legally deserve. Life insurance denial cases can be complicated, so it’s smart to have our expertise on your side.

A life insurance company can and will deny a claim, and do so in multiple ways. The company may take advantage of loopholes in your insurance policy (which is a legally binding contract), or look for reasons to exclude coverage in the original policy application. It may also deny a claim based on more clearly valid reasons, such as unpaid policy premiums or if the death occurred due to illegal activities or other situations spelled out in the policy as exclusions.

When the insurance company’s refusal to pay a death claim isn’t clear, you should consider consulting with a life insurance attorney for guidance.

There’s no one answer to this question, and any reputable life insurance lawyer will not give you a guarantee of success, but we can tell you that a case that will resolve without litigation may take between three and six months. If litigation is needed, it may be a year or more due to backlogs in the courts.

We begin our work for you by collecting all of the relevant information via a letter of representation to the insurer requesting the entire claim file related to the policy in question. We then use that information to find the relevant case law in the governing jurisdiction that will support the payment of benefits for you.

Once we’re confident that we’ve found sufficient law to support our position, we send a comprehensive appeal letter to the insurance company. If the company refuses to overturn their denial, we’ll review all of your viable options with you, which may include litigation, a secondary appeal, the collection of additional information, and more.

We work with you on a contingency fee basis, which means that Life Legal doesn’t get paid unless our life insurance attorneys recover money on your behalf.

Any costs associated with the collection of medical records, hiring experts, or filing fees will be covered by Life Legal and then recouped from the sum we recover on your behalf along with our contingency fee. If we don’t recover any money on your behalf, we don’t get paid and we don’t collect the expenses incurred in pursuing your claim.

Thanks to the multiple ways we now have to quickly, safely, and efficiently communicate with our clients, such as via Zoom, email, and telephone, a formal consultation isn’t necessary. We would be happy, however, to schedule one if it makes you feel more comfortable as you begin to work with us.

It’s important to us to keep you informed of any substantial update on your case because we know how important it is to you. We do our very best to make sure you’re up-to-date on your case, but we welcome you to call, text, or email us with your questions at any time.

Aside from signing a few documents along the way and responding to our calls or emails, there will be little involvement on your part. We are, though, glad to handle your case in a more collaborative way if you wish to be more involved in the process.

Insurance companies usually send benefit checks to our office via certified mail. Once we’ve received it, we will subtract the costs that were incurred and our contingency fee, then send your portion of the funds to you via certified mail.
